Important: Use this digital-artwork marketplace honestly. Do not exploit checkout, resell source files outside your Licence, upload someone else’s private likeness without authority, commit impersonation fraud or compromise Accounts. Good-faith statutory and cardholder disputes are not prohibited. |

1. Scope & relationship with other documents
1.1 This Acceptable Use Policy governs access to Profile Studio, creation and management of Accounts, purchases of Ready-Made Artwork, commissioning of Custom Artwork, the provision of visual references, downloading of files and subsequent use of artworks supplied by DIGIMACIS LTD. Its purpose is to protect customers, creators, rights holders and the security and integrity of the digital marketplace. It applies to registered and guest customers alike and to anyone acting through their access credentials.
1.2 Read this Policy together with the Terms & Conditions, Privacy Policy, Cookie Policy, Refund Policy, Payment Policy, Cancellation Policy and Digital Product Fulfilment Policy. The Terms & Conditions determine the rights licensed with an artwork; this Policy controls how the Website may be used and how orders and digital material may be handled. Where a specific product licence allows a use more precisely, that licence governs its authorised scope, provided the use is lawful. Mandatory consumer and privacy protections always prevail over inconsistent restrictions.
2. Core principle of permitted use
2.1 Customers may browse the catalogue, compare sizes and styles, buy artwork for lawful personal or permitted commercial projects, create a genuine customer Account, submit an original and lawful brief for Custom Artwork and download and use properly paid-for files within their licence. Reasonable cropping, resizing or adapting to a platform's profile-image dimensions is ordinarily permitted when it does not prejudice a creator's rights or create a misleading claim of authorship.
2.2 You must act honestly, respect other users' privacy, protect payment systems and follow reasonable security and purchase instructions. Permission to view a webpage does not authorise copying the full catalogue, extracting other customers' data, recreating the business's services or using its infrastructure as a platform for unrelated activity. Conduct is assessed according to its context, potential harm, available evidence and the actual rights granted, rather than a single automated indicator.
3. Account integrity & identity
3.1 Create only Accounts needed for a legitimate purpose. Register under accurate contact information, keep credentials confidential and update the email address used for order support. Do not access another person's account or order, impersonate an officer or artist, obtain access through a leaked password or evade a documented restriction by rotating names, devices or email addresses. Account recovery requires reasonable evidence that the requester controls the relevant Account.
3.2 Do not sell, rent, lend or transfer Account credentials, customer order identifiers or download entitlements, or let third parties exploit access to files outside the purchased Licence. A customer may engage an authorised employee or designer to assist with permitted uses of a purchased asset if the customer retains control, the original licence allows that work and no unauthorised onward distribution occurs. Suspected compromise should be reported immediately to info@profile-studio.com; support may verify identity before resetting access.
4. Prohibited payment / checkout behaviour
4.1 You must use a payment method with its lawful holder's permission and provide truthful billing information. Prohibited conduct includes testing stolen cards, repeated artificial authorisations, manipulating totals or tax values, exploiting coupon flaws, engineering duplicate refunds, using another person's payment credentials or concealing that a purchase was made on behalf of an unauthorised party. We may reject or hold an affected Order while payment or identity information is reasonably verified.
4.2 A genuine claim for unauthorised payment, non-delivery, defect or misdescription is always permitted. You must not deliberately represent a successfully delivered and knowingly purchased file as unauthorised or undelivered in order to retain the asset and recover the price. Contacting the card issuer remains a lawful option; nothing here removes card-scheme or statutory dispute rights. Supporting evidence may be reviewed as described in the Refund Policy and Payment Policy, with access restrictions proportionate to substantiated misuse.
5. Prohibited gameplay / fair-use abuse
5.1 Profile Studio is a digital avatar marketplace, not a gaming, token-trading or cash-prize service. Its fair-use controls address customer order and promotion integrity, not in-game competition. You must not coordinate artificial orders, create multiple Accounts to claim an offer repeatedly when it is limited to one customer, exploit referral incentives, trigger repeated downloadable entitlements through technical defects or take deliberate advantage of mispriced checkout quantities or processing errors.
5.2 You may legitimately compare prices, download your purchased files within ordinary use limits and report a malfunction. Automated access or parallel accounts become problematic when used to avoid payment, defeat platform limits, divert licences or materially disrupt service for others. When an error gives access to the wrong file or another customer's artwork, stop using the unexpected material and notify support; corrective handling should not deprive a customer of properly paid-for rights.
6. Prohibited technical interference
6.1 You must not attempt unauthorised access to servers, administrative interfaces, payment integrations, user data, private media paths or creator tools. Malware injection, credential stuffing, denial-of-service activity, deliberate security-control circumvention, automated checkout attacks and scraping designed to reproduce substantial protected catalogue content are prohibited. Do not alter browser or network requests to change entitlements, disclose private order data or manufacture evidence of completed payment.
6.2 Security research is not authorised simply because a page is publicly accessible. If you identify an apparent vulnerability, report it privately to info@profile-studio.com without collecting private information, accessing another user's account, degrading service or publishing exploit details that create avoidable harm. We may throttle unusual traffic, require reauthentication, suspend affected functionality or preserve forensic logs where reasonably necessary for network security and lawful investigations.
7. Content, conduct & communications standards
7.1 Your Custom Artwork brief, uploaded reference images, brand materials and communications must be lawful and must not facilitate harassment, credible threats, hate-driven abuse, child sexual abuse or exploitation, non-consensual intimate imagery, extortion, phishing, impersonation scams or other harmful conduct. Do not upload another identifiable person's image or sensitive information without lawful authority for the proposed processing and publication. A public image found online is not automatically free for appropriation.
7.2 Do not request avatar design that intentionally confuses others about an actual person's identity, misrepresents an official authority, facilitates fraud or deceptively uses another person's trademark. Requests involving fictional characters, parody, public figures or commercial marks may require a rights assessment, and we may seek evidence of authorisation or a revised brief. The Service's ability to generate or supply an image does not establish that you have permission to publish or monetise it in every context.
8. Intellectual property & unauthorised commercial exploitation
8.1 Purchasing an avatar is not a transfer of source-code rights, creator authorship, exclusive merchandising rights or copyright title. Unless the specific licence expressly allows otherwise, you must not resell digital files as independent stock assets, distribute them as templates, sublicense downloads, use purchased artwork to train a competing model or package images for unrestricted third-party redistribution. You may use an ordinary purchased avatar for your own channel, profile or allowed brand presentation within the Licence.
8.2 Do not remove ownership notices to falsify provenance, pass off an AI-assisted catalogue item as a bespoke commissioned original where that claim is misleading, or assert guaranteed copyright registration of AI-generated components. Some products may contain AI-generated imagery and others may be creator-made or commissioned. You should assess permissions for characters, logos, likenesses and commercial promotions independently. Requests for extended licensing or an express copyright assignment must be agreed in writing by the rights holder.
9. Account trading / transfers / virtual-goods misuse
9.1 Download links, order entitlements and any incidental account credits are tools for accessing digital content; they are not cryptocurrency, electronic money, bank balances or stored value. Do not advertise or operate an unauthorised market for those access rights, sell passwords or order receipts as redeemable claims, use Profile Studio to transmit value or exchange a digital entitlement for cash. An artwork licence may be used as expressly stated, but an underlying account right or unspent download entitlement is not freely transferable.
9.2 Where an affected Order is refunded or charged back, its undelivered entitlement may be cancelled and related access removed, subject to lawful exceptions and the rights explained in the Refund Policy. Voluntary Account closure may end account-based access to unclaimed files; it does not automatically cancel a valid licence to lawfully paid-for and downloaded artwork. Misusing technical faults to obtain duplicate products or selling access to unpurchased materials may lead to entitlement correction and proportionate account controls.
10. Children / age / protective restrictions
10.1 The Service is designed for adults aged 18 or older. Do not create or operate an Account for an under-18 user, knowingly arrange purchases on behalf of a minor contrary to applicable law or use a minor's payment instrument without lawful authorisation. An adult purchasing lawful artwork for a legitimate adult-controlled project remains responsible for complying with all applicable protections where images of children or other vulnerable persons are involved.
10.2 Never submit exploitative or sexualised imagery of children, seek to identify or locate a child through the Service or disclose personal information about minors in a brief without the requisite lawful basis and care. We may refuse related instructions, restrict access and report apparently unlawful content or threats to appropriate authorities where legally required or justified. Children's information is managed under the Privacy Policy and applicable legal obligations, regardless of any account eligibility restriction.
11. Reporting, investigations & cooperation
11.1 Report fraud, compromised Accounts, suspected infringement, unsafe briefs or access errors to info@profile-studio.com. Supply the relevant order identifier, dates, affected product and a clear description, without emailing complete card numbers, passwords or unnecessary sensitive images. We may ask for additional proportionate information to identify the order or verify that the reporter has authority to request action. Reports will be evaluated in good faith and should not be used to harass competitors or other customers.
11.2 We may preserve transaction records, download event logs, communications and technical indicators in accordance with the Privacy Policy to investigate a credible report. We may contact the customer for clarification or notify payment intermediaries and competent authorities where legally appropriate. An allegation alone does not establish misconduct. We may correct an erroneous restriction, restore access or provide a written explanation of a significant outcome where legally and technically feasible.
12. Enforcement measures
12.1 Depending on severity and evidence, we may give a warning, request removal of a prohibited reference, reject or pause a brief, limit abnormal traffic, require password reset, withdraw wrongfully issued entitlements, suspend access, cancel an unperformable Order or terminate an Account. Immediate restriction may be justified where credible ongoing fraud, account compromise, abuse material or network harm makes prior notice impracticable. Otherwise we seek a proportionate response with a reasonable opportunity to resolve a misunderstanding.
12.2 Enforcement does not authorise confiscation of valid purchased rights without lawful basis, refusal of mandatory remedies for defective digital content or retaliation for an honestly presented complaint, data request or cardholder dispute. Where a paid order cannot be fulfilled due to our rejection or service decision, the Refund Policy and applicable consumer law govern restitution. A customer may contact support for review of a restriction, supplying the order number and relevant reasons.

13. Relationship to refunds / cancellation / data requests
13.1 The Refund Policy controls entitlement reversals, non-delivery claims and approved reimbursement; the Payment Policy controls authorisation, duplicate transactions and card disputes; and the Cancellation Policy controls Account closure. A documented breach may affect whether continued access can be supplied lawfully, but a contract restriction cannot eliminate a customer's non-excludable refund or repair rights. Customer-facing decisions should identify the affected Order and the available support channel rather than relying on a blanket assertion that all sales are final.
13.2 Account termination is distinct from erasing personal data. We may retain records when necessary to meet legal obligations, prevent fraud or address a live dispute, while responding to valid privacy requests in accordance with the Privacy Policy. No customer is required to waive rights of access, rectification, complaint or lawful objection in order to seek a refund. If an entitlement is reinstated following review, we aim to restore access without creating a second unauthorised charge.
14. Amendments & version control
14.1 We may revise this Policy to respond to changes in law, licence arrangements, platform security or the nature of products offered. The updated text will be made accessible through the Website with an effective date. Where a material change affects ongoing Account use, we will give reasonable notice when practicable and required. Continued use after a properly notified prospective change signifies acceptance only to the extent permitted by applicable law.
14.2 Changes do not retrospectively confiscate purchased digital rights, enlarge an existing Licence without agreement or reduce mandatory remedies for orders formed under prior terms. Customers should keep their order confirmation and the licence supplied with their purchased item. Questions about policy versions may be directed to support. A product-specific written licence remains authoritative on the rights it expressly grants.
15. Contact
15.1 For content reports, account-security issues, suspected unauthorised activity, accessibility concerns or questions about permitted artwork use, contact DIGIMACIS LTD, trading as Profile Studio, at info@profile-studio.com. Include the relevant order or Account details and a short explanation; omit passwords and full card numbers. We aim to acknowledge support correspondence within two Business Days, although urgent threats may require different investigative priorities.
15.2 This Policy is governed by the laws of England and Wales, subject to the mandatory laws protecting consumers in their country of residence and all non-excludable statutory rights. Disagreements should first be raised through the support channel without preventing a customer from contacting an applicable consumer authority, data-protection regulator, card issuer or competent court. No provision requires a consumer to abandon a lawful remedy.
Illustrative Examples of Unacceptable Use
A customer creates six new Accounts to claim a single-customer welcome promotion repeatedly, then requests refunds for files already downloaded. Promotional access may be restricted, overlapping orders reviewed and any genuine refund claims still individually assessed.
A buyer obtains a ready-made avatar, uploads the source file to an online stock marketplace for third parties to buy as an unrestricted image, and falsely claims copyright ownership. This infringes the ordinary Licence, so we may demand removal and restrict further access while preserving lawful complaint routes.
An individual asks a creator to make a convincing avatar of another person for the purpose of impersonating that person in a financial scam. The brief may be refused and escalated based on the supported fraud indicators; an approved payment for work that will not be supplied is handled under the Refund Policy.
A developer finds a cart error that creates an extra download link. Instead of collecting dozens of files, the developer reports the error privately. The report is legitimate; exploiting the issue to acquire more files without payment is prohibited.
A cardholder discovers a genuinely unknown card charge and reports it to their bank and Profile Studio. That is not abusive chargeback activity, even if our system initially shows the payment as authenticated. The claim must be reviewed on the evidence and applicable cardholder rights.
User Good-Faith Expectations
Before ordering, confirm the avatar variant, intended use, final EUR amount, licence and electronic delivery method. For Custom Artwork, provide a lawful and reasonably complete brief, answer clarifying questions and confirm any separately agreed changes or extra fees in writing. Do not upload another person's likeness or private data simply because the image can be found through a search engine.
After purchase, retain the order confirmation and keep purchased files backed up securely. Report missing downloads with an order number and do not attempt repeated payment submissions solely to obtain a second link. Raise disagreements politely, protect payment credentials and allow support a reasonable opportunity to investigate while retaining your full statutory and scheme dispute options.
If you believe a security, copyright, privacy or order-integrity decision was mistaken, explain the facts and request review through info@profile-studio.com. The objective of enforcement is to prevent misuse and correct genuine problems, not to penalise lawful customers who report concerns. Every application of this Policy remains subordinate to applicable consumer and data-protection law.
